What’s the Delay With Getting My SARS Refund?

The Income Tax filing season is open and many taxpayers are eagerly awaiting the refund they submitted their return. SARS used to refund taxpayers who were due refunds quickly – within a day or two. However, since 2014, tax advisors and auditors have seen various changes in the process resulting in refund delays. The questions are, why is the SARS process extended now and what are the three reasons why taxpayers have to wait so long for refunds?

1) Invalid RAV01 banking details

Invalid banking details according to SARS records may delay your refund. To prevent fraud, SARS verifies a number of taxpayers’ bank details. Before filing your Income Tax return, ensure that the banking details appearing on your RAV01 form (available on SARS e-filing) show that they are valid. If you have changed your banking details since your previous tax return submission, first update your details on the RAV01 form and then file your return. In some cases SARS may require you to personally visit your nearest SARS branch to verify the change in your bank details. You will be notified in writing. Note that certain supporting documents are required (be sure to ask before going to SARS).

2) Special SARS Stopper:

The special stopper placed on refunds can only be removed at a SARS branch. You must provide SARS with proof of your residential address, a certified copy of your ID and a bank statement not older than 3 months stamped by the bank.

3) Verification of your tax return:

South Africa has seen a significant increase in the amount of taxpayers being selected for a review or verification. If SARS asks for supporting documentation, make sure you upload all the relevant documentation used to compile the income and expenses claimed in your return. It is advisable to prepare a schedule summarizing (for example) all your medical expenses incurred. If you receive a travel allowance remember to include a detailed logbook and proof of car purchase.

The South African Revenue Service (“SARS”) has published deadlines for submitting Income Tax returns. The deadlines depend on the method of submitting the tax return. These deadlines do not apply to companies that must submit their returns within 12 months of their financial year end through e-Filing.

The 2017 Tax Season officially begins on July 1, 2017 and individual taxpayers can submit their returns for the tax year ending on February 28, 2017. eFilers are first in line and can file from 1 July while SARS branches and the contact center are open for assistance only from 3 July 2017.

The Income Tax Act has been amended to impose administrative penalties for non-compliance. These penalties can vary from R250 to R16,000 per month. Please ensure that you have all supporting documentation for your return as SARS may request this if you are selected for a review. Protect supporting documentation for at least five years in case SARS needs access to it in the future.
